The Probate Division of the Kaduna State Judiciary is a specialized unit under the High Court of Justice that is responsible for the administration of the estates of deceased persons within Kaduna State. It operates under the legal framework provided by the Kaduna State High Court (Civil Procedure) Rules 2007 and other related laws governing wills, probate, and administration of estates in Nigeria.
KEY FUNCTIONS OF THE PROBATE DIVISION
- Validation of Wills: The division is responsible for validating wills presented for probate to ensure their authenticity, legality, and compliance with required formalities.
- Issuance of Grants of Probate: When a valid will exists, the Probate Division issues Grants of Probate to the named executors, empowering them to manage and distribute the deceased's estate according to the provisions of the will.

- Lack of Awareness Among the Public: Many people remain unaware of probate processes, legal requirements for estate administration, or the importance of creating wills. This leads to confusion, misinformation, and errors when applying.
- Manual and Paper-Based Operations: The division relies heavily on manual record-keeping and paper-based processes, which are inefficient, time-consuming, and prone to errors or document loss.
- Cumbersome Procedures for Intestacy: In cases of intestacy, the process for obtaining Letters of Administration can be overly complex, especially for small estates, causing unnecessary stress for beneficiaries.
